Welcome to the Terms of Service for MapperHealth Services (this "Agreement"). MapperHealth Services are owned and operated by MapperHealth, LLC ("We," "Our," "Us," or "MapperHealth"). Please read this Agreement carefully before using any MapperHealth Services. By accessing or using any MapperHealth Services, You agree to be bound by this "Agreement", which is a legally enforceable agreement between MapperHealth and You, the individual ("You" or "Your"). Throughout the Agreement, "MapperHealth Services" refers only to the specific MapperHealth Service that You have enrolled in or have scheduled a consultation for and not any of the other MapperHealth Services that are described in this Agreement. This Agreement is in addition to, and not in lieu of, any additional documentation you may be required to agree to as part of MapperHealth Services. 1. MapperHealth Services This Agreement applies to Your use of any of the services offered by or through MapperHealth that are listed and further described below (the "MapperHealth Services"): a. Medication Monitoring b. DNA Collection c. DNA Sequencing d. DNA Analysis e. Telehealth Consults f. Ongoing Patient Care Features and specifications of the MapperHealth Services described or depicted herein are subject to change at any time without notice. 2. No Medical Advice Although MapperHealth Services are health services, MapperHealth Services do not offer medical advice and do not create a doctor-patient relationship between You and MapperHealth. Any MapperHealth Services provided or content accessed through MapperHealth Services are for informational purposes only and are not intended to cover all possible uses, directions, precautions, drug interactions, or adverse effects. This includes, but is not limited to, the information provided by MapperHealth in response to questions You may submit during a session, chat, or other interaction. Any content You receive as a result of utilizing MapperHealth Services should not be used during a medical emergency or for the diagnosis or treatment of any medical condition. Please consult Your doctor or other qualified healthcare provider if You have any questions about a medical condition or before taking any drug, changing Your diet, or commencing or discontinuing any course of treatment. Do not ignore or delay obtaining professional medical advice because of information accessed through MapperHealth. Call 911 or Your doctor for all medical emergencies. MAPPERHEALTH IS NOT RESPONSIBLE OR LIABLE FOR ANY ADVICE, COURSE OF TREATMENT, DIAGNOSIS OR ANY OTHER INFORMATION, SERVICES OR PRODUCTS THAT YOU MAY OBTAIN THROUGH YOUR UTILIZATION OF MAPPERHEALTH SERVICES. MapperHealth Services do not provide medical advice, diagnosis, or treatment. MapperHealth Coaches and Guides are not licensed mental health professionals. Telehealth Consults and eConsults provided pursuant to MapperHealth Services are performed by licensed health professionals employed by or contracted with MapperHealth. 3. Your Account and Your Use of MapperHealth Services You must provide accurate and complete registration information any time You register to use MapperHealth Services. It is Your responsibility to provide Us with a true, accurate, and complete email address, physical mailing address, and other information related to Your account, and to maintain and update promptly any changes in this information. To further the integrity of MapperHealth services, You are limited to the creation of a single account, provided that parents and legal guardians may also create an account for each of their minor children. Violation of this policy may lead to the suspension or termination of Your account(s). You are solely responsible for maintaining the confidentiality and security of Your password and account, and You are fully responsible for all activities that occur under Your password or account. You agree to immediately notify MapperHealth of any unauthorized use of Your password or account or any other breach of security, and You agree to ensure that You logout from Your account at the end of each session. MapperHealth shall not be liable for any loss or damage arising from Your failure to comply with this Agreement. 4. Use of Your Information/Privacy Policy and Practices/Feedback Only provide information that You own or have the right to use while using MapperHealth Services. MapperHealth will only use information You provide as permitted by MapperHealth's Notice of Privacy Practices and applicable law, including the Health Insurance Portability and Accountability Act ("HIPAA"). MapperHealth may contact You regarding information about MapperHealth Services in accordance with the Member Communication Policy. You acknowledge and consent to receive communications by, but not limited to, email, regular mail, manual or automated text message or SMS, MMS, push notification or in-app message, manual or automated telephone calls, or other reasonable means now known or hereafter developed regarding Your healthcare and other services through the contact information You have provided, including Your mobile number. 5. Intellectual Property MapperHealth Services are owned by MapperHealth. We grant to You, for Your personal purposes only, a nonexclusive, limited and revocable license to access and use MapperHealth Services during the term of the MapperHealth Services in which are You enrolled, so long as You comply with the terms of this Agreement. You agree not to use MapperHealth Services for any other purpose, including commercial purposes, such as co-branding, framing, linking, or reselling any portion of MapperHealth Services without Our prior written consent. 6. Right to Change Terms of Service MapperHealth may, at any time and from time to time, amend this Agreement. Any changes to this Agreement will be effective immediately upon posting of the changed Terms of Service. You agree to review the Terms of Service periodically and Your use of MapperHealth Services following any such change constitutes Your agreement to follow and be bound by this Agreement as amended. 7. Disclaimer of Warranty; Limitation of Liability MAPPERHEALTH SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. MAPPERHEALTH, ITS CLIENTS, AND ITS SUPPLIERS DISCLAIM ALL EXPRESS AND IMPLIED WARRANTIES WITH REGARD TO THE INFORMATION, SERVICES AND MATERIALS CONTAINED ON MAPPERHEALTH SERVICES, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. 8. Indemnification You agree to indemnify, defend, and hold harmless MapperHealth, its clients, and its suppliers and their respective affiliates, employees, officers, directors, agents, servants, shareholders, and representatives of each from any liability, loss, claim, suit, damage, and expense (including reasonable attorneys' fees and expenses) related to Your violation of this Agreement, Your use or misuse of MapperHealth Services, or Your posting of material to MapperHealth Services. 9. Applicable Law This Agreement and the resolution of any and all disputes related to this Agreement shall be construed in accordance with the laws of the Commonwealth of Massachusetts. Any dispute between MapperHealth and You related to this Agreement shall be resolved exclusively by the state and federal courts of the Commonwealth of Massachusetts. 10.
